LIFEKEY LIMITED WARRANTY

DISCLAIMER:

Sytec Health LLC (including its affiliates, managers, officers, agents and employees, collectively, "Sytec") makes no warranty, expressed or implied, and Sytec expressly disclaims all warranties of merchantability and fitness for a particular purpose. [note: this might need to be revised if there is a limited warranty offered] Sytec shall have no liability for consequential, exemplary or incidental damages even if it has been advised of the possibility of such damages. Further, you understand that you alone control access to your LifeKey™. If you do not password protect access to your LifeKey™, there is the possibility that someone might gain unauthorized access to your medical records; alternatively, if you password protect your LifeKey™ and are unable to communicate your password to emergency medical personnel, and if such personnel fail to reach your emergency contact, then there exists the possibility that your medical records will not be accessible. In any case, Sytec™ shall have no liability whatsoever with respect thereto, and you hereby agree to indemnify and hold harmless Sytec™ with respect to any claim to the contrary.

If there is currently a warranty offered on LifeKey, then such warranty should be limited as follows: "The maximum liability of Sytec is limited to the purchase price of LifeKey™. Such liability shall be limited [insert time duration] from the date of original purchase. This warranty is in lieu of all other warranties, expressed or implied. The purchaser's exclusive remedy shall be only as stated herein. This warranty does not apply to any LifeKey™ which in the judgment of Sytec has been subject to misuse, neglect or accident or which has been damaged through abuse, alteration, improper installation or application, or negligence in use, storage, transportation or handling, or repair. Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you."
